How many owners can be mentioned in the Sale Agreement?

There is a maximum limit of 4 owners that can be mentioned in the Sale Agreement.

What is the difference between Leasehold and Freehold properties?

A Leasehold property is a property that is leased out by Emaar Properties to a Lessee for a specific period of time. A Freehold property is a property that is sold outright for a specific purchase price to a Purchaser and there is no limit on ownership rights.

Why is the Plot size not mentioned in my Sale Agreement?

We no longer specify the actual Lot area in our Sales Agreements due to the possibility of slight variation arising from topographical conditions. We can issue a letter confirming that the designated plot area for developed property and that the actual area following completion will not materially differ.

Why is the rate of maintenance fees not specified in the Sale Agreement?

The rate of maintenance fees is a tangible amount and not part of the Agreement and is auxiliary to the policies of the Finance Department at Emaar Properties. However the Sale Agreement does mention the payment of maintenance fees.

Why do we sign Sale Agreements with Springs, Meadows, Arabian Ranches, Dubai Marina and the like and not with Emaar?

The Agreement is always signed between the Purchaser and the respective Company that is considered to be the Vendor. However, the Vendor company is a subsidiary of Emaar Properties PJSC.

Why does the Sale Agreement mention that if the customer is in default we charge him interest commencing on the date of default and when delay occurs on behalf of the Vendor the Customer has to wait?

There are some clauses that are standard to all Sale Agreements and there is a three month period mentioned in the Contract beyond the Completion Date whereby the Vendor can delay the Completion of the project. The delays arise only in cases where the Force Majeure is a factor.

Are modifications to the property allowed?

No, in line with the Covenants and Warranties of the Purchaser as mentioned in the Sale Agreement, there cannot be any exterior construction, alteration or modification to the property.

Can we avail of a Sale Agreement in Arabic?

Regrettably, the Sale Agreement is printed in a standard format and language.

Can I add or delete the names from my Sale Agreement?

For completed properties; customers would have to apply for NOC from Emaar for completing the required addition/deletion of names in the property ownership.

What happens if I lose my Sale Agreement?

You would need to attend the Contracts Helpdesk and sign and indemnity form. You will also need to provide us with an affidavit citing the reasons for the loss of the contract duly signed by a local lawyer or a court notary. The veracity of your request will then be verified and if genuine, a new Sale Agreement will be issued upon payment of a nominal fee of AED 3,000.

Why does Emaar retain 2 original copies of the Sale Agreement and provide the customer with only one original copy of the Sale Agreement?

Emaar as the Vendor will retain one original copy of the Sale Agreement and the other one is to be deposited with the Lands Department at the time of registration of the title deed.

How many days does it take for me to receive my Contract for signature from the date of Sales Launch?

Usually it should not take the Sale Centre more than 7 days to generate a contract and seek your signatures. Once you have signed the contract, it will take another three days for the Vendors signatures and return.
